Channel of Complaint Protocol

Organic Law 5/2010 introduced into the Criminal Code the possibility that legal persons could be convicted of certain crimes. As a consequence of this and being the fulfillment of the legality one of the essential principles and values that governs its activity, ENUSA has implemented a Model of Organization, Management and Control for Crime Prevention (hereinafter, the “Model”), in which establishes the necessary norms and controls to try to avoid, as far as possible, the commission of criminal behavior by the administrators, managers and employees of ENUSA or, at least, when this is not possible, to facilitate their detection.

One of the most relevant controls established by the Model (also provided for in the Code of Conduct) is the obligation of all administrators, managers and employees of ENUSA to report to the Surveillance Authority the existence of non-compliances with standards and controls Contained in the Model, the Code of Conduct and the Anti-Corruption Protocol. Such is the importance of this obligation that, without it, it would be highly difficult to prevent and detect crimes, since it is the people of ENUSA who, as in every company, have direct knowledge of the actions carried out within it.

The objective of the Channel of Complaints Protocol is therefore the establishment of a set of rules that regulate a specific channel by which the persons that conform ENUSA can fulfill their obligation to denounce to the Surveillance Organ of the irregularities of which they have knowledge with freedom, without fear of reprisals and guaranteeing their confidentiality. Likewise, said Protocol establishes the appropriate mechanisms for the respect of the rights of the person denounced, including those recognized in the regulations for the protection of personal data.
